Weddings of Hawaii Terms and Conditions
Please read these Terms & Conditions carefully. Weddings of Hawaii strives to make every wedding as perfect as it can be so that you can cherish these priceless moments for a lifetime. Understanding the items below will help us work together to make that possible. Please feel free to contact us directly with any questions. These terms and conditions constitute an agreement between you as the client and Weddings of Hawaii. These terms and conditions are binding upon payment of the deposit by the client.
Bookings, Cancelations, Modifications, Deposits, and Payments
All bookings and modifications must be submitted to and confirmed by Weddings of Hawaii in writing (email or mail). Deposits are required for all packages and are non-refundable. The final balance is due and payable no later than 30 days prior to the wedding date. Cancellations and package modifications (including additions and deductions) must be submitted in writing and approved by Weddings of Hawaii at least 30 days prior to the wedding date. No refunds will be issued on cancellations made within 30 days of the wedding date. Modifications to a package of less value following the payment of the deposit are not permitted. Once the deposit is paid, Weddings of Hawaii will allow a maximum two package decrease in the wedding package selection, if the change is made at least 30 days prior to the wedding date.
Due to the significant amount of time that must be reserved for the Lehua, Royal Ilima, Monarch Elite, and Kalani Ilima Wedding Packages, we do not allow these packages to be downsized, unless a request is made in writing and approved by Weddings of Hawaii at least 90 days prior to the wedding date.
Payment for all wedding services is due 30 days prior to the event. All policies, packages, and pricing are subject to change without notice. While we make every effort to maintain prices as quoted, they are subject to change without notice. All transactions are subject to applicable sales tax.
Weddings of Hawaii will work with you to plan each detail that you desire for your wedding. To facilitate this process, we ask that all specific requests be submitted in writing (email or mail) not less than 30 days before the wedding date so that we can work to make your wedding as perfect as it can be. Please give thought as to your preferences for venues, entertainment, timing, and other particulars that you would like. Please submit your final attendance numbers no later than 30 days prior to your wedding date. All selections and wedding details are subject to change from time to time in the sole discretion of Weddings of Hawaii.
Weddings of Hawaii reserves the right, and the client irrevocably consents and authorizes Weddings of Hawaii to use, reproduce publish and copyright each of the names, likenesses, images, voices, and performances, in whole or in part, any and all film footage, prints, photographs and/or other media taken during the wedding ceremony and/or reception. You understand that the media, negatives, copies or reproductions shall be the sole property of Weddings of Hawaii, to be used and disposed of in commerce or otherwise, with or without compensation to Weddings of Hawaii, in perpetuity and without limitation. You hereby waive any right to inspect or approve the finished product or the use to which it may be applied. You agree to release and indemnify the Weddings of Hawaii from and against any and all claims for invasion of privacy, defamation and any other cause of action, including without limitation all attorneys’ fees and costs reasonably incurred in connection therewith, arising out of the production, publication, display and exhibition or use of their likeness, image, voice, interview and performance.
Circumstance Beyond the Control of Weddings of Hawaii
It is understood and agreed that Weddings of Hawaii, its employees, agents, or contractors performing hereunder shall not be held liable, and Weddings of Hawaii denies responsibility in the event a scheduled wedding or reception cannot take place or is delayed due to circumstances beyond its control. In the event of weather conditions, road conditions, traffic, mechanical difficulties, strikes, lockouts, riots, or for any reason whatsoever, Weddings of Hawaii may at any time and without prior notice cancel, advance, postpone or deviate from any scheduled event and shall not be liable for any loss whatsoever incurred by reason of such cancellation, advancement, postponement or deviation. You understand and accept all risks associated with unforeseen circumstances and other items beyond your and Weddings of Hawaii’s control.
Wedding couples are responsible for obtaining a marriage license prior to their event (this document cannot be obtained by anyone other than the wedding couple). Wedding couples who fail to obtain this document understand their service will cary no legal value. Weddings of Hawaii provides instructions to obtain the document in the reservation confirmation and website at www.wedhawaii.com.
Weddings of Hawaii is not responsible compliance with or the existence of any venue restrictions, including but not limited to, restrictions on open flames, sand, rice or other toss items, and decorations such as rose petals and other floral and non-floral décor, and is not responsible for any adverse impact on the ceremony as a result of such restrictions. For all public permitted venues, Weddings of Hawaii does not permit any outside wedding decore or setups, such as, but not limited to, any arches, chairs or tents. All locations are entered at the individuals own risk. Weddings of Hawaii is not liable should any individual associated with the wedding party or guests of wedding party suffer an injury or become physically ill.
Sound and Entertainment
Weddings of Hawaii is not responsible for any sound or music services used during the ceremony, reception, or other event, including amplification for the officiant, clients, readers and/or musicians. In the event that the client uses the sound equipment provided by Weddings of Hawaii or its vendors, they understand that they are not professional sound engineers and the equipment is not a substitute for professional sound equipment.
Officiants, Photographers, Videographers, and Other Wedding Day Vendors
In the event of an emergency or unexpected circumstance preventing a scheduled officiant, photographer, videographer, or other wedding day vendor from performing his or her services, Weddings of Hawaii shall in its sole discretion provide a replacement officiant, photographer, etc. if necessary, without the clients’ prior approval.
By booking the specific services for your ceremony, you agree that the ceremony shall begin at the specified time booked. The officiant and other scheduled vendors must be able to begin the ceremony at the scheduled time in order to stay on schedule for other scheduled weddings and events. You understand and agree that you may be charged additional fees and costs if the vendor/s must wait to start the ceremony past the scheduled time, and further that neither the officiant nor other scheduled vendors is required to stay past the scheduled time of completion for the ceremony or event.
Limitations of Liability
To the maximum extent permitted by law, and not withstanding any other provision of this Agreement, the you agree to limit the Company’s liability for any and all claims, losses, costs, damages of any nature whatsoever or claims expenses from any cause or causes, including attorneys’ fees and costs and expert witness fees and costs, so that the total aggregate liability of Weddings of Hawaii shall not exceed the total costs paid for the wedding package and additional services purchased. You further agree to indemnify, defend and hold harmless Weddings of Hawaii and its employees, agents, independent contractors, officers, directors, members and/or managers for any injury, property damage, liability, claim or other cause of action arising out of or related to your actions or the actions of your guests.
You agree that these terms and conditions and the transactions between you and Weddings of Hawaii are subject to, and shall be interpreted and governed by the laws of the State of Hawaii, and that the parties hereto agree that any legal action taken by either party shall be instituted and prosecuted in the Circuit Courts of the First Circuit, State of Hawaii. You further agree that the prevailing party shall be entitled to reimbursement by the non-prevailing party of all reasonable attorneys’ fees and costs incurred.
These terms and conditions constitute the entire agreement between the parties, and supersede all prior agreements whether oral or written concerning the subject matter of this agreement. By placing a booking and paying a deposit, you understand these terms and conditions and agree to be bound by them.
